How can you change property managers?

The property manager plays an important role in the management of the building. But sometimes the co-owners are not entirely satisfied. Perhaps communication is too slow, work is not running smoothly, or one simply wants a breath of fresh air. In that case, the VME can decide to change property managers.
The transition always happens via the general meeting (AV). The agenda must clearly state that the appointment or renewal of the property manager is being discussed. All co-owners can vote on this. Usually a simple majority is sufficient to choose a new property manager.
- What if the contract is still running?
Even if the property manager has a contract of, for example, three years, the general meeting can still decide to terminate this earlier. In that case, the property manager must still be paid for the remaining term, unless there are serious errors or mismanagement. The law thus protects the co-owners, but also ensures that the property manager is properly compensated.
- Extraordinary general meeting
Normally, an ordinary general meeting is held once a year. However, an extraordinary general meeting (BAV) can also be scheduled in between. This can be at the request of the property manager themselves, but also when at least 1/5th of the co-owners request it. This way, one does not have to wait a whole year to make urgent decisions, such as appointing a new property manager.
- Practical
If the meeting decides to switch, the current property manager is officially dismissed and the new property manager is immediately designated. The old property manager must then correctly transfer all documents and accounts of the building, so that the new property manager can start without problems.
In short: switching property managers can always be done, even if the contract is still running. It can be done via the annual meeting, but also faster via an extraordinary AV. It requires a clear decision from the co-owners, but the process itself is simple and legally well regulated.
