Terms and Conditions

These general terms and conditions (hereinafter: 'Terms') apply to all services provided by Syndicus Service, with registered office at Huikstraat 47, 2000 Antwerp, registered in the Antwerp legal entities register and known to the VAT administration under number BE 0715.596.120 in its capacity as property manager and administrator of co-ownerships.

1. Definitions

In these Terms, the following is understood:

• 'VME': Association of Co-Owners.
• 'User': any co-owner, resident or authorized person who uses our services.
• 'Platform': the online portal and digital communication channels offered by Syndicus Service.
• 'WhatsApp communication': messages sent to users via WhatsApp, subject to prior consent.

2. Scope of application

These Terms apply to all contractual and non-contractual legal relationships between Syndicus Service and the User, including the use of the Platform, digital communication channels and all other services provided by Syndicus Service.

3. Services of the property manager

Syndicus Service performs its tasks in accordance with Belgian co-ownership law and the mandate approved by the VME. This includes, among other things, administrative and financial management, technical maintenance, organization of general meetings and communication with co-owners.

4. Access to the platform and communication channels

Access to the Platform is granted exclusively to co-owners and their authorized representatives. The User is responsible for keeping their login credentials confidential and for any use that occurs through their account.

5. Code of conduct

Users must refrain from offensive, discriminatory, intimidating or defamatory statements. Misuse of the Platform or communication tools may result in temporary or permanent exclusion.

6. Owner data and privacy

Contact details of co-owners may be visible to other co-owners within the same building, unless the person concerned uses the opt-out option via beheer@mysebas.be. The processing of personal data is carried out in accordance with Syndicus Service's privacy policy.

7. WhatsApp communication

Syndicus Service may send messages via WhatsApp regarding the management of the co-ownership, subject to prior consent from the User. For essential communication (e.g., urgent interventions), WhatsApp may also be used without consent, in accordance with legitimate interest. The User can unsubscribe at any time.

8. Liability

Syndicus Service is only liable for damage that is the direct and immediate consequence of a failure attributable to it. It is not liable for indirect damage, consequential damage or loss of data. The liability of Syndicus Service is always limited to the amount covered by its professional liability insurance.

9. Force majeure

In case of force majeure (such as strikes, pandemics, power outages, natural disasters), Syndicus Service is not obliged to fulfill its obligations during the period that the force majeure situation persists.

10. Intellectual property

All content of the Platform, including texts, logos, images and software, is the property of Syndicus Service or its licensors and may not be copied, distributed or modified without prior written consent.

11. Changes to the Terms

Syndicus Service reserves the right to modify these Terms. Modified Terms will be communicated via the Platform or by email and will take effect on the date stated in the notice.

12. Applicable law and competent court

These Terms are governed exclusively by Belgian law. Disputes fall under the exclusive jurisdiction of the courts of the Antwerp judicial district.
